Takanaka vă invită să citiți cu atenție Termenii și Condițiile prezentate mai jos.
Comanda oricărui bun sau serviciu prin acest site sau în mod telefonic arată faptul că sunteți de acord să respectați acești Termeni și Condiții.
În cazul în care nu sunteți de acord sau nu acceptați, fără limitări sau calificări, Termenii și Condițiile de utilizare ale acestui website, vă rugăm să încetați utilizarea acestuia.
Site-ul își rezervă dreptul de a actualiza/modifica oricând Termenii și Condițiile, fără o notificare prealabilă, urmând ca actualizările/modificările să fie opozabile de la data afișării lor pe site.
INFORMAȚII DESPRE ADMINISTRATOR SITE/VÂNZĂTOR
Site-ul https://takanaka.ro este proprietatea BSB SPORTS & SERVICES SRL cu sediul social în Municipiul București, Strada Zăgazului, Nr. 4E, înregistrata la Oficiul Registrului Comerțului de pe lângă Tribunalul București sub nr. J40/3664/2013, având Cod unic de înregistrare RO17907625, cont bancar RO55 BTRL RONC RT02 1219 8001 deschis la Transilvania Suc. Lipscani, e-mail: office@takanaka.ro telefon: +40 721 000 026, denumită în continuare administrator site/vânzător.
DEFINIȚII
Termenii folosiți în continuare vor avea următorul înțeles:
– Administrator site/vânzător – BSB SPORTS & SERVICES SRL
– Client sau cumpărător – orice persoană fizică sau persoană juridică care se înregistrează în site prin crearea și utilizarea unui Cont de Utilizator și care lansează o comandă prin intermediul site-ului, conform procedurii stabilite în Termeni și Condiții;
– Utilizator – orice persoană fizică sau persoană juridică care a creat un cont de utilizator pe site;
– Vizitator – orice persoană fizică sau juridică care accesează site-ul, fără a crea un cont de utilizator și fără a plasa o comandă;
– Contul de Utilizator – metoda de înregistrare și autentificare în site, formată dintr-un username și o parolă care permite cumpărătorului să lanseze o comanda prin intermediul site-ului; contul de utilizator cuprinde date de identificare ale cumpărătorului și istoricul comenzilor plasate de către cumpărător.
Utilizatorul:
(i) declară că toate informațiile introduse la crearea Contului sunt reale, corecte, complete și actualizate;
(ii) își asumă răspunderea pentru menținerea confidențialității datelor de cont (user și parolă) și pentru gestionarea accesării contului;
(iii) acceptă în mod expres și fără echivoc Termenii și Condițiile în versiunea care este afișată pe site la data utilizării site-ului/plasării comenzii. Ulterior creării Contului, utilizarea site-ului echivalează cu acceptarea modificărilor intervenite asupra Termeniilor și Condițiilor afișate pe site;
– comanda – document în format electronic, întocmit de cumpărător și remis vânzătorului, prin intermediul site-ului, prin care cumpărătorul își manifestă intenția fermă de a achiziționa unul sau mai multe produse din oferta vânzătorului, plătind prețul acestora;
– convenția/contractul – comanda confirmată de vânzător conform Termenilor și Condițiilor;
– oferta – propunerea de vânzare adresată cumpărătorului, prezentată prin intermediul site-ului;
– comunicarea comercială – orice formă de comunicare (e-mail/SMS/telefonic etc.) destinată să promoveze, direct sau indirect, produsele, serviciile, imaginea, numele ori denumirea, firma sau emblema societății BSB SPORTS & SERVICES SRL.
PLASAREA COMENZII
Orice comandă pe care o plasați este condiționată de disponibilitatea produselor în acel moment, de disponibilitatea livratorilor și de acceptul nostru. Comanda poate fi plasată pe site sau prin intermediul telefonului la numerele afișate pe site.
Pentru plasarea unei comenzi on-line se vor selecta produsele dorite prin apăsarea butonului ”ADD to cart”. Utilizatorul își va putea regăsi produsele selectate în coșul de cumpărături aflat în partea dreapta, în colțul superior al paginii, iar pentru finalizarea comenzii și pentru plasarea efectivă a acesteia, clientul va accesa butonul de checkout. După plasarea comenzii, un operator va contacta clientul pentru a confirma comanda și datele acestuia și pentru a comunica timpul estimat de livrare – acesta poate varia în funcție de condițiile de trafic, de condițiile meteorologice sau de alte condiții neprevăzute.
La momentul plasării comenzii, clientul trebuie să furnizeze următoarele informații:
- Nume și prenume
- Adresa de livrare
- Numărul de telefon
- Adresa de e-mail
- Alegerea orei de livrare, dacă este cazul
- Modalitatea de plată
În cazul în care datele de contact comunicate la plasarea comenzii (în formularul de comandă sau telefonic) nu sunt corecte (sau clientul nu poate fi contactat la numărul de telefon menționat la plasarea comenzii), ne rezervăm dreptul de a anula livrarea comenzii.
Dacă produsele nu sunt disponibile sau în cazul în care nu există capacitate de livrare, un operator vă va înștiința telefonic.
Programul de lucru este de luni până vineri între orele 12:00 și 20:00.
PREȚURI ȘI MODALITĂȚI DE PLATĂ
Orice contract pentru produsele comandate de pe acest site este încheiat între client și BSB SPORTS & SERVICES SRL.
Prețurile indicate pe site sunt în lei (RON) și includ T.V.A., conform legislației în vigoare. Taxele privind livrarea produselor se vor calcula separat, atunci când veți urma pașii plasării comenzii dumneavoastre. Prețul pentru produsul deja comandat nu poate fi modificat, însă BSB SPORTS & SERVICES SRL are dreptul de a schimba prețurile în viitor și de a modifica produsele și serviciile disponibile spre vânzare pe site-ul www.takanaka.ro . Prețul total al comenzii de bunuri va fi afișat pe site în momentul plasării comenzii. Plata trebuie să se facă integral, pentru toate bunurile expediate, iar metoda de plată trebuie selectată la plasarea comenzii
Modalitățile de plată acceptate de către BSB SPORTS & SERVICES SRL:
- Cu cardul bancar de debit sau de credit, la plasarea comenzii. Cardurile acceptate pentru plata on-line a produselor sunt: Visa, Visa Electron, Mastercard / Eurocard, Maestro, inclusiv cardurile virtuale Visa și Mastercard. Vânzătorul are dreptul să anuleze comanda în cazul în care tranzacția nu a fost acceptată de către banca emitentă a cardului cumpărătorului.
LIVRAREA PRODUSELOR
Livrarea se realizează doar pentru comenzile care se află în zona de livrare indicată pe site la secțiunea “delivery zone” și este gratuită pentru comenzile cu o valoare de minimum 70 lei. BSB SPORTS & SERVICES SRL livrează doar în anumite zone din București și din Ilfov. Pentru cereri speciale ne puteți contacta la numărul de telefon destinat comenzilor de pe site. Ne rezervăm dreptul de a refuza o comandă în cazul în care aceasta nu se regăsește în perimetrul afișat pe site.
Toate comenzile vor fi livrate de către un curier ce face parte din echipa Takanaka. Noi vom face tot ceea ce este posibil pentru a prepara și a livra produsele în termenul precizat, cu toate acestea, însă nu vom fi răspunzători față de client pentru orice pierderi, datorii, costuri, daune sau cheltuieli care decurg din livrarea cu întârziere. Dacă comanda nu este livrată în timpul estimat, ne puteți contacta prin telefon sau e-mail și noi vom depune toate eforturile în încercarea de a livra comanda cât mai repede posibil.
Timpul concret de livrare este determinat ținând cont de distanța până la adresa clientului, de situația traficului, de condițiile meteorologice și de alte circumstanțe neprevăzute. Depășirea termenului de livrare poate fi cauzată de evenimente de forță majora precum și de oricare factor enunțat mai sus.
La momentul livrării clientul trebuie să asigure accesul livratorului în casă / clădire și să răspundă la numărul de telefon menționat la plasarea comenzii, pentru cazurile în care livratorul nu reușește să găsească adresa exactă sau să obțină accesul în clădire. În cazul neacceptării livrării comenzii în timpul de livrare comunicat sau în cazul în care livratorul nu reușește să livreze comanda din cauza instrucțiunilor inadecvate ale clientului sau a lipsei de răspuns la apelurile livratorului, aceste comenzi vor fi considerate a fi livrate către dumneavoastră și, implicit, toate riscurile și costurile în legătură cu astfel de comenzi vor fi plasate asupra dumneavoastră.
În cazul în care circumstanțe neprevăzute împiedică clientul să primească comanda, este necesar să contacteze telefonic operatorii cât mai curând posibil și să restabilească locul și timpul de livrare.
RETRAGEREA CLIENTULUI. RETURNAREA PRODUSELOR
În cazul în care cumpărătorul constată că produsul primit prezintă abateri de la caracteristicile menționate în comandă (ex: mâncare diferită, porții diferite etc.), produsul pare a fi impropriu consumului uman sau este incomplet, acesta are dreptul să solicite vânzătorului înlocuirea produsului sau să i se restituie contravaloarea acestuia. Reclamația privind starea produselor trebuie comunicată la intrarea în posesie a acestora, telefonic sau prin e-mail, urmând a fi soluționată după ce se verifică starea produselor. În cazul în care, în urma verificării se dovedește că produsele nu respectă cerințele menționate de către client în comandă, produsele se înlocuiesc, dacă se mai află în stoc, sau BSB SPORTS & SERVICES SRL se angajează să restituie întreaga sumă și să nu revândă produsele neconforme către alt client. BSB SPORTS & SERVICES SRL rambursează toate sumele pe care le-a primit drept plată din partea cumpărătorului în termen de 14 zile de la data la care este informat de decizia de retragere din contract a cumpărătorului, folosind aceleași modalități de plată ca și cele folosite de cumpărător pentru tranzacția inițială.
Deoarece produsele conțin alimente proaspete și perisabile, cumpărătorul nu beneficiază de dreptul de a se retrage din contract, respectiv de a returna produsele fără a fi nevoit să justifice decizia de retragere.
OBLIGAȚIILE CUMPĂRĂTORULUI
Cumpărătorul se obligă să citească, să accepte și să respecte Termenii și Condițiile vânzătorului odată cu utilizarea site-ului și cu lansarea comenzilor și să achite contravaloarea produselor comandate prin metodele puse la dispoziție de vânzător.
Cumpărătorul se obligă să furnizeze informații reale, corecte și actuale despre identitatea sa pentru crearea Contului de utilizator și atunci când acestea i se cer, în caz contrar existând posibilitatea refuzării comenzilor; cumpărătorul poate modifica, completa sau actualiza datele sale de identificare prin accesarea secțiunii „Contul meu”. Vânzătorul are dreptul să anuleze comanda în cazul în care datele cumpărătorului sunt incomplete.
Cumpărătorului îi revine obligația de a-și actualiza ori de câte ori este cazul datele din Contul de utilizator.
OBLIGAȚIILE VÂNZĂTORULUI
Vânzătorul se obligă să contacteze clienții pentru confirmarea comenzilor, prin e-mail sau telefonic. Vânzătorul se obligă să utilizeze datele personale colectate de la clienți/utilizatori în concordanță cu secțiunea „Politica de confidențialitate. Prelucrarea datelor cu caracter personal”, parte integrantă din Termeni și Condiții.
LIMITAREA RĂSPUNDERII
Produsele comercializate de vânzător sunt concepute și pregătite astfel încât să respecte cerințele legale și standardele relevante de sănătate și siguranță din România.
Cumpărătorii sunt informați asupra caracteristicilor esențiale ale produselor comercializate de către vânzător (ingrediente, gramaj, preț per unitate). Prin intermediul site-ului, vânzătorul pune la dispoziția vizitatorilor/cumpărătorilor informațiile aferente produselor listate. Cumpărătorii sunt informați despre prețul final al produsului, pe care îl suportă, care va cuprinde toate costurile, inclusiv taxa pe valoare adăugată și toate costurile suplimentare.
Produsele comercializate de către vânzător nu sunt destinate revânzării.
Vânzătorul se preocupă ca toate caracteristicile produsului prezentate pe site să fie cele corecte, însă în situația în care, din eroare, un produs comercializat și comandat are afișate caracteristici greșite sau neconforme, vânzătorul va aduce aceasta împrejurare la cunoștința cumpărătorului și are dreptul de a anula comanda.
Imaginile publicate pe site sunt cu titlu de exemplu, având caracter ilustrativ, iar produsele livrate pot diferi de imaginile prezentate în orice mod (culoare, aspect etc). De asemenea, ambalajul produselor poate varia fata de ambalajul prezentat pe site.
Vânzătorul își rezervă dreptul de a modifica unilateral informațiile produselor fără nicio formalitate suplimentară.
Utilizatorii înțeleg și acceptă că BSB SPORTS & SERVICES SRL este absolvit de orice răspundere în eventualitatea producerii oricărei opriri, întreruperi, îngreunări, disfuncționalități sau erori în funcționarea Site-ului, în situația unei erori tehnice de orice fel sau oricăror erori în furnizarea Serviciului, precum și în orice situație în care nu s-ar dovedi cert culpa BSB SPORTS & SERVICES SRL în orice erori sau probleme de natură tehnică din cele menționate mai sus. În cazurile de forță majoră, BSB SPORTS & SERVICES SRL este exonerat total de răspundere.
DREPTURI DE PROPRIETATE INTELECTUALĂ
Toate drepturile de proprietate intelectuală revin BSB SPORTS & SERVICES SRL. Orice utilizare a site-ului sau a conținutului acestuia (de exemplu: imagini, descrieri/texte, elemente grafice, simboluri, scripturi, programe, comentarii, logo-uri, reprezentări stilizate etc.), în alt scop decât pentru uzul personal și necomercial al vizitatorului/utilizatorului este interzisă fără acordul scris al administratorului.
Accesul vizitatorului/utilizatorului la site este limitat, în interesul personal al acestuia, înțelegându-se prin aceasta dreptul de a accesa site-ul strict în scopul vizualizării produselor și/sau pentru plasarea unei comenzi.
Încălcarea dreptului de proprietate intelectuala de către vizitator/utilizator atrage angajarea răspunderii acestuia, civilă, penală sau de orice altă natură și, în consecință, dă posibilitatea administratorului să inițieze orice demers judiciar sau extrajudiciar. În acest caz, administratorul va putea pretinde vizitatorului/utilizatorului acoperirea prejudiciului material și moral suferit.

– Customer or buyer – any natural or legal person who registers on the site by creating and using a User Account and who places an order through the site, according to the procedure established by the Terms and Conditions;
– User – any natural or legal person who has created a user account on the site;
– Visitor – any natural or legal person who accesses the site, without creating a user account and without placing an order;
– User Account – the method of registration and authentication on the site, consisting of a username and a password that allows the buyer to place an order through the site; the user account includes the identification data of the buyer and the history of the orders placed by the buyer.
The User:
(i) declares that all information entered in the creation of the Account is real, correct, complete and up to date;
(ii) assumes responsibility for maintaining the confidentiality of the account data (user and password) and for managing the account access;
(iii) expressly and unequivocally accepts the Terms and Conditions in the version that is displayed on the site at the date of using the site / placing the order. PLACING THE ORDER
Any order you place is conditioned by the availability of the products at that time, by the availability of suppliers and by our acceptance. The order can be placed on the site or by phone at the numbers displayed on the site.
To place an on-line order, select the desired products by pressing the “ADD to cart” button. The user will be able to find the selected products in the shopping cart located on the right side, in the upper corner of the page, and to complete the order and for its effective placement, the customer will access the checkout button. After placing the order, an operator shall contact the customer to confirm the order and its data and to communicate the estimated delivery time – this may vary depending on traffic conditions, weather conditions or other unforeseen conditions.
When placing the order, the customer must provide the following information:

- Choice of delivery time, if applicable
- Method of payment
If the contact details communicated when placing the order (in the order form or by phone) are not correct (or the customer cannot be contacted at the phone number mentioned when placing the order), we reserve the right to cancel the delivery of the order.
If the products are not available or if there is no delivery capacity, an operator shall notify you by phone.
The working hours are from Monday to Friday between 12:00 and 20:00.
PRICES AND METHODS OF PAYMENT
Each contract for the products ordered from this site is concluded between the client and BSB SPORTS & SERVICES SRL.
The prices listed on the site are in lei (RON) and include V.A.T., according to the legislation in force. Products delivery charges shall be calculated separately when you follow the steps in order to place the order. The price for the product already ordered cannot be modified, but BSB SPORTS & SERVICES SRL has the right to change the prices in the future and to modify the products and services available for sale on the website www.takanaka.ro. The overall price of the goods order shall be displayed on the site when placing the order. The payment is to be made in full for all shipped products, and the payment method is to be selected at the moment of placing the order.
Methods of payment accepted by BSB SPORTS & SERVICES SRL:
- Debit card or Credit bank card, when placing the order. Accepted cards for online payment of products are: Visa, Visa Electron, Mastercard / Eurocard, Maestro, including Visa and Mastercard virtual cards. The seller has the right to cancel the order if the transaction has not been accepted by the issuing bank of the buyer’s card.
PRODUCTS DELIVERY
Delivery is made only for orders that are in the delivery area, which is indicated on the site, in the “delivery area” section, and is free for orders with a value of at least 70 lei. BSB SPORTS & SERVICES SRL delivers only in certain areas of Bucharest and Ilfov. For special requests please contact us at the phone number listed on the site. We reserve the right to refuse an order if it is not found in the perimeter displayed on the site.
All orders shall be delivered by a courier who is part of the Takanaka team. We will do everything possible and out best to prepare and deliver the products within the specified time. However, we shall not be hold responsible to the customer for any losses, debts, costs, damages or expenses arising from late delivery. If the order is not delivered in the estimated time, please contact us by phone or by e-mail and we will do our utmost to try to deliver the order placed as soon as possible.
The specific delivery time is determined taking into account the distance to the customer’s address, the traffic situation, the weather conditions and other unforeseen circumstances. Exceeding the delivery deadline may be caused by force majeure events as well as by any of the above factors.
At the time of the delivery, the customer must ensure the supplier‘s access to the house / building and answer the phone number mentioned at the moment of placing the order, in cases where the supplier fails to find the exact address or gain access to the building. In case of non-acceptance of the order, during the communicated delivery time, or in case the supplier fails to deliver the order due to the inadequate instructions of the customer or the lack of answer to the supplier’s calls, these orders will be considered delivered to you. The risks and costs associated with such orders will be borne by you.
If unforeseen circumstances prevent the customer from receiving the order, it is necessary to contact the operators by phone, as soon as possible and to re-establish the place and time of delivery.
CUSTOMER WITHDRAWAL. PRODUCTS REFUND
If the customer notes that the product received deviates from the characteristics mentioned in the order (eg: different food, different portions, etc.), the product appears to be unfit for human consumption or is incomplete, the customer has the right to ask the seller to replace the product or to be reimbursed for its value. The complaint regarding the condition of the products is to be communicated upon their possession, by telephone or by e-mail, and shall be settled after the products is verified by us. If after the verification it is proved that the products do not comply with the requirements mentioned by the customer in the order, the products are to be replaced, if they are still in stock, or BSB SPORTS & SERVICES SRL undertakes to return the full amount and not to resell the non-compliant products to another customer. BSB SPORTS & SERVICES SRL shall reimburse all amounts of money received as payment from the customer within 14 days from the date on which it is informed of the decision to withdraw from the contract of the buyer. The refund shall be made using the same payment methods as those used of the customer for the initial transaction.
Because the products contain fresh and perishable food, the customer does not have the right to withdraw from the contract or to return the products without having to justify the withdrawal decision.
THE CUSTOMER’S OBLIGATIONS
The customer undertakes to read, accept and comply with the seller’s Terms and Conditions that comes from using the site and launching any orders and to pay the value of the products ordered through the methods provided by the seller.
The customer undertakes to provide real, correct and current information about his/her identity at the moment of creating the User Account and any time it is requested, otherwise we reserve the right to refuse the orders. The customer can modify, complete or update his/her identification data by accessing the “My account” section. The seller has the right to cancel the order if the customer’s data is incomplete.
The customer has the obligation to update the data in the User Account whenever necessary.
THE SELLER’S OBLIGATIONS
The seller undertakes to contact the customers in order to confirm their orders, by e-mail or by telephone. The Seller undertakes to use the personal data collected from Customers / Users in accordance with the section “Privacy Policy. LIMITATION OF LIABILITY
The products marked by the seller are designed and prepared in order to comply with the legal requirements and relevant health and safety standards in Romania.
The customers are informed about the essential characteristics of the products marked by the seller (ingredients, weight, price per unit). Through the site, the seller makes available to visitors / customers the information related to the listed products. The customers are informed of the final price of the product, which will include all costs, including value added tax and all additional costs. The final price will be borne entirely by the customer.
The seller is looking forward that all product features presented on the site are correct, but if, by mistake, a product sold and ordered has displayed wrong or non-compliant features, the seller shall inform the customer which has the right to cancel the order.
